These Terms of Service ("Terms") are a legal agreement between you ("you," "your," "Student") and ASL Pinnacle LLC, a Delaware limited liability company with a business address at 5013 S. Louise Avenue, Suite 1507, Sioux Falls, SD 57108 ("ASL Pinnacle," "we," "us," "our").
These Terms govern your use of www.aslpinnacle.com (the "Site") and all courses, tutoring, webinars, materials, and related services we offer (collectively, the "Services").
By creating an account, purchasing any product, or using the Site, you agree to these Terms. If you do not agree, do not use the Services.
1. ELIGIBILITY AND ACCOUNTS
1.1 Minimum age
You must be at least 16 years old to use the Services. We do not knowingly provide Services to anyone under 16 or collect personal information from anyone under 16.
1.2 Students aged 16–17
If you are 16 or 17, a parent or legal guardian must review and accept these Terms on your behalf and is responsible for all fees and for your compliance with these Terms. By enrolling a student aged 16 or 17, the parent or guardian accepts these Terms on the student's behalf and agrees to be bound by them.
1.3 Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. Accounts are personal and non-transferable. You may not share your account, credentials, or access with any other person. Sharing account access is grounds for immediate termination without refund.
1.4 Accurate information
You agree to provide accurate, current information at registration and to keep it updated.
1.5 Communications from us
By enrolling, you agree that we may contact you by email about your enrollment, schedule, payment, and platform access. These are service messages and are necessary while you are enrolled. Marketing email is separate and you may unsubscribe at any time.
2. THE SERVICES
We currently offer three categories of product. Different terms — particularly refund terms — apply to each.
- Courses. Term-based online ASL instruction delivered through our learning platform, at levels including 1A through 4.
- Tutoring. Sessions scheduled between you and a tutor, offered in individual, paired, and small group formats.
- Webinars. Live or recorded professional development sessions, offered individually or as a Full Access Pass, sometimes carrying CEU opportunities.
We may add, modify, or discontinue products at any time. Changes will not affect a product you have already paid for in the then-current term.
3. PAYMENT
3.1 Payment in advance
All products must be paid for in full before access is granted, except where a payment plan has been expressly agreed in writing.
Tutoring sessions must be paid for at least 48 hours before the scheduled session time, or at the time of booking where a session is booked less than 48 hours in advance. A session that has not been paid for may be canceled without notice.
3.2 Prices
Prices are stated in U.S. dollars on the relevant product page and are exclusive of any taxes that may apply. You are responsible for any applicable taxes, currency conversion charges, or bank fees.
3.3 Payment plans (courses only)
Where we offer a payment plan for a course, you authorize us to charge your payment method on the agreed schedule. If a scheduled payment fails and is not cured within 7 days of our notice to you, we may suspend or terminate your access to the course. Amounts already paid remain subject to Section 4.
3.4 Payment processing
Payments are processed by Stripe, Inc. We do not receive or store your full card number. Your use of Stripe is subject to Stripe's own terms and privacy policy.
3.5 Chargebacks
If you dispute a charge with your bank or card issuer rather than contacting us first, we may suspend your access pending resolution. Filing a chargeback for a purchase that is non-refundable under these Terms is a breach of this agreement, and we may recover the disputed amount, associated fees, and reasonable costs of collection. Please contact us first — most disputes are resolved faster directly.
4. REFUNDS AND CANCELLATION
Refund terms depend on the product purchased. The $40 processing fee referenced below is non-refundable in all cases where it applies.
4.1 Courses
Refunds for term-based courses are calculated from the published first day of the term:

All times are measured against the published start time of the first day of the term, Pacific Time.
Withdrawal requests must be submitted in writing to the email address in Section 17 and are effective on the date we receive them. Non-attendance, non-participation, or failure to log in does not constitute withdrawal and does not entitle you to a refund.
If you are on a payment plan and withdraw, the same schedule applies to the total course price, and any remaining scheduled payments up to the amount owed remain due.
4.2 Tutoring
- Student cancellation. If you cancel a prepaid session at least 24 hours before the scheduled start time, you are entitled to a refund or may apply the payment to a future session.
- Late cancellation and no-shows. If you cancel with less than 24 hours' notice or do not attend, no refund or credit will be given.
- Tutor cancellation. If the tutor cancels a session at any time before it begins, you will receive a refund or, by mutual agreement, credit toward a future session.
- Late arrival by the tutor. If the tutor arrives late, the lost time will be made up by extending that session or another session, as mutually agreed.
- Late arrival by the student. The tutor will wait 15 minutes from the scheduled start time. After 15 minutes the session is treated as a no-show. If you arrive late within that window, you will be tutored only for the remaining scheduled time; sessions will not be extended.
- Fees. Fees are based on the scheduled session length. Late arrival or early departure by the student does not reduce the fee.
Paired and group tutoring. Paired and group sessions are booked by students who already know one another and wish to learn together. The following additional rules apply:
- Pricing differs by format. Individual, paired, and group sessions are each priced separately, and the rate is set by the format booked at the time of booking.
- If one participant cancels or does not attend, the session proceeds as scheduled for the remaining participants, and their fees are not adjusted. The session is not re-priced to the individual rate.
- A cancelling participant's own refund is governed by the 24-hour rule above.
- If all participants cancel with at least 24 hours' notice, the session is canceled and each receives a refund or credit.
- Where one person books and pays for the whole group, that person is our contracting party, is responsible for the full fee, and receives any refund due. Participants in that arrangement should raise cancellation and refund questions with the person who booked, not with us.
- Participants in a paired or group session will see and be seen by one another. By booking a shared session you accept this, and Section 7 applies to every participant.
4.3 Webinars
Refund terms for webinars vary by event. The refund and cancellation policy applicable to a given webinar or Full Access Pass is the policy published on that event's registration page at the time you complete your purchase. That published policy is incorporated into these Terms and governs your purchase. We will not apply a less favorable policy to a purchase after it has been made.
If no refund policy is published for a particular webinar, the following default applies:
- Full refund if canceled at least 24 hours before the session's start time (Pacific Time).
- Within 24 hours of the start time but before the session begins, you may transfer your registration to another session or receive credit toward a future webinar, rather than a refund.
- Once the session has begun, fees are non-refundable.
- No-shows are not eligible for a refund or credit, regardless of reason.
For a Full Access Pass, once the series has started, no partial refunds or credits will be issued for remaining sessions.
4.4 Cancellation and changes by us
Minimum enrollment. We may cancel a course that does not reach the minimum enrollment needed to run it. If we cancel a course for insufficient enrollment, we will notify enrolled students at least seven (7) days before the published first day of the term and refund all amounts paid in full, including any processing fee.
Other cancellation. If we cancel any course, session, or webinar for any other reason and do not offer a reasonable rescheduled alternative that you accept, you will receive a full refund of amounts paid for the canceled product, including any processing fee. This is your sole remedy for our cancellation.
Schedule changes. If illness, emergency, or other circumstances prevent a scheduled session from taking place, we will reschedule it at a mutually workable time or, where rescheduling is not possible, refund the affected portion. We may also make reasonable changes to schedules, session times, and platform.
4.5 Consumers in the European Union, United Kingdom, and European Economic Area
If you are a consumer resident in the EU, UK, or EEA, you may have a statutory right to withdraw from a distance contract within 14 days. Because our Services are digital content and online services supplied immediately:
By purchasing and requesting immediate access, you expressly consent to immediate performance of the contract and acknowledge that you thereby lose your statutory right of withdrawal once performance has begun.
Where the law of your country of residence grants you rights that cannot be waived or limited by contract, those rights are unaffected by these Terms.
5. ACCESS PERIOD
5.1 Courses
Access to a course, its materials, and its platform areas begins on the first day of the term and ends 30 days after the last day of the term. After that grace period, access is withdrawn.
5.2 No perpetual access
We do not offer lifetime or perpetual access to any product. Course materials, platforms, and third-party tools change over time, and we make no commitment to maintain any particular material, format, or platform indefinitely.
5.3 Webinars
Access to webinar recordings, where offered, is for the period stated on the event's registration page.
5.4 Technical requirements
You are responsible for your own device, internet connection, and any software needed to access the Services. We are not responsible for your inability to access the Services due to your equipment, connection, or local restrictions.
6. INTELLECTUAL PROPERTY
6.1 Ownership
All course content, curricula, video, images, signed instruction, written materials, quizzes, assessments, film guides, slide decks, handouts, and the design and organization of the Services are the property of ASL Pinnacle LLC or its licensors and are protected by copyright and other intellectual property laws. Nothing in these Terms transfers ownership of anything to you.
6.2 Your license
Subject to your payment and compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the materials for your own individual, non-commercial learning during your access period.
6.3 What you may not do
You may not, and may not permit anyone else to:
- copy, reproduce, download, screen-record, screenshot, or otherwise capture any course video, live session, or instructional material, except where we expressly provide a file for download. You may of course take your own handwritten or typed notes for your personal study — what this prohibits is capturing or reproducing our materials themselves;
- share, distribute, publish, post, upload, resell, sublicense, rent, or otherwise make available any materials to any other person, whether or not for payment;
- share your account credentials or allow another person to use your access;
- use any materials to create, deliver, or support instruction offered by you or by any other person or organization;
- use any materials to train, fine-tune, or evaluate any artificial intelligence or machine learning system;
- remove or obscure any copyright notice, watermark, or attribution;
- circumvent, disable, or interfere with any access control, DRM, or security feature of the Site or platform.
6.4 Downloadable materials
Some materials are supplied as files intended to be saved to your device. Where we expressly make a file available for download, you may download and retain it for your own personal study only. All other restrictions in Section 6.3 continue to apply to that file — in particular, you may not share, post, or redistribute it.
6.5 Your content
You retain ownership of assignments, recordings, and other work you submit. You grant us a non-exclusive, royalty-free license to store, display, and use your submissions solely for the purpose of delivering, assessing, and supporting the Services. We will not use your work for marketing or promotion without your separate written permission.
6.6 Enforcement
Violation of this Section is grounds for immediate termination of access without refund, and we reserve all rights to pursue any remedy available at law, including statutory damages and injunctive relief.
7. RECORDING AND CLASS PRIVACY
7.1 You may not record
You may not record, photograph, screenshot, stream, or otherwise capture any live class, tutoring session, webinar, or any other student, instructor, or interpreter appearing in them, by any means, without our prior written permission and the consent of every person captured. This is a strict rule. In a visual language classroom, a recording captures a person's face, body, and identity, not merely their words.
Two exceptions:
- Recording yourself. You may record yourself signing, including where an assignment requires it, provided no other participant appears in the recording.
- Accessibility accommodations. If you need to record in order to participate — for example because of a disability affecting processing, memory, or vision — contact us. We will work with you to find an approach that meets your needs and protects other students, which may include a recording made by us and shared only with you. Do not record first and ask afterward.
7.2 Recording by us
We sometimes record brief portions of live sessions — typically a minute or two — for instructional, promotional, or archival purposes. Where a student may appear in such a recording, we obtain that student's written permission in advance using a separate release form. You are never required to consent to appear in a recording as a condition of participating in a course, and declining will not affect your grade, standing, or access.
You may withdraw your consent to future use of a recording at any time by contacting us. We will stop using it going forward, though we may be unable to retrieve material already published or distributed.
7.3 Confidentiality of the classroom
What other students share in class, in tutoring, or in community spaces is theirs. Do not repeat, publish, or post it outside the class.
8. CODE OF CONDUCT
ASL Pinnacle teaches American Sign Language as a language and Deaf culture as a living culture belonging to Deaf people. Participation in the Services requires you to conduct yourself accordingly.
8.1 Expected conduct
You agree to:
- treat instructors, interpreters, staff, and fellow students with respect;
- respect the privacy of others, including the recording rules in Section 7;
- engage in good faith with the learning process, including in group and community settings;
- come prepared, with your materials, homework, and any required equipment ready before the session begins;
- in tutoring, help identify the areas where you need work, so that sessions can be used well;
- follow reasonable instructions from your instructor regarding class conduct.
8.2 Prohibited conduct
You may not:
- Engage in audism — treating Deaf people as lesser, deficient, or in need of fixing; treating hearing norms as default or superior; questioning a Deaf person's competence, intelligence, or authority on the basis of deafness; speaking over, for, or about Deaf people rather than with them.
- Appropriate or misrepresent ASL or Deaf culture — presenting yourself as a qualified interpreter, teacher, or cultural authority on the basis of coursework taken here; performing ASL as decoration, aesthetic, or content divorced from the community; monetizing ASL instruction or performance in ways that displace Deaf practitioners; using our instruction to hold yourself out as certified in any capacity we have not certified you in.
- Gatekeep or police identity — challenging any participant's Deaf, hard of hearing, DeafBlind, DeafDisabled, or hearing identity, their signing ability, their audiological status, or their right to be in the space.
- Harass, demean, threaten, or discriminate against any person on the basis of deafness, disability, race, ethnicity, national origin, religion, sex, gender identity or expression, sexual orientation, age, or any other protected characteristic.
- Post or share sexually explicit, violent, hateful, or unlawful content in any class or community space.
- Disrupt classes, community spaces, or other students' learning.
- Impersonate any other person, including any instructor or staff member.
8.3 Scope
This Code of Conduct applies to all interactions connected with the Services, including live classes, tutoring sessions, webinars, platform discussion areas, our optional Discord community, and direct communication with instructors, staff, or other students arising from the Services.
8.4 Enforcement
We may, at our discretion and depending on severity, issue a warning, remove content, restrict participation in community spaces, or terminate your access without refund. For serious violations — harassment, unauthorized recording, distribution of materials — we will terminate immediately without warning.
We are the sole judge of what constitutes a violation, and we will not enter into extended debate about it.
9. OPTIONAL COMMUNITY SPACES
We operate an optional community server on Discord. Participation is not required, and choosing not to participate will not affect your coursework, grade, or standing in any way.
Discord is operated by a third party. If you join, you are entering into a separate relationship with Discord under Discord's own terms of service and privacy policy, and Discord collects information from you directly. We do not control Discord and are not responsible for it. We recommend you review Discord's policies before joining.
The Code of Conduct in Section 8 applies fully to our Discord server. We may remove you from it for any violation.
10. NO WARRANTIES AND NO GUARANTEE OF OUTCOMES
We work hard to teach well. We do not promise results.
We make no warranty, express or implied, regarding your performance, progress, fluency, comprehension, test results, certification eligibility, employment prospects, or any other outcome arising from the Services. Language acquisition depends primarily on your own practice and engagement.
Completion of any course does not certify, qualify, or credential you as an ASL interpreter, ASL teacher, or ASL professional of any kind. Interpreting and teaching credentials are issued by independent bodies with their own requirements.
Where CEUs are offered in connection with a webinar, eligibility and award are subject to the requirements of the issuing body, not ours.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
11. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW:
We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Services, whether based in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising out of or relating to the Services will not exceed the amount you paid to us for the specific product giving rise to the claim in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless ASL Pinnacle LLC, its members, officers, instructors, and contractors from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any law, your infringement of any third party's rights, or your unauthorized use or distribution of our materials.
13. THIRD-PARTY SERVICES AND LINKS
The Services rely on and link to third-party platforms, including our hosting provider, payment processor, video conferencing tools, and community platforms. We are not responsible for the content, availability, terms, or privacy practices of any third party. Your use of a third-party service is governed by that service's own terms.
14. SUSPENSION AND TERMINATION
14.1 By you
You may stop using the Services at any time. Refunds are governed solely by Section 4.
14.2 By us
We may suspend or terminate your access, in whole or in part, immediately and without notice, if you breach these Terms, violate the Code of Conduct, fail to pay, or engage in conduct we reasonably believe is unlawful or harmful to others.
Termination for breach does not entitle you to any refund.
14.3 Survival
Sections 6, 7.3, 10, 11, 12, 15, and 16 survive termination.
15. GOVERNING LAW AND DISPUTE RESOLUTION
15.1 Governing law
These Terms are governed by the laws of the State of South Dakota, without regard to its conflict of laws principles.
15.2 Informal resolution first
Before filing any claim, you agree to contact us and attempt to resolve the dispute informally. Most problems are solved in an email. We commit to responding in good faith within 30 days.
15.3 Venue
Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Minnehaha County, South Dakota, and you consent to the personal jurisdiction of those courts. This does not prevent either of us from bringing an individual claim in a small claims court with jurisdiction over the matter.
15.4 Consumers outside the United States
If you are a consumer resident outside the United States, nothing in this Section deprives you of the protection of mandatory provisions of the law of your country of residence, or of the right to bring proceedings in the courts of your country of residence where the law grants you that right.
16. GENERAL
Entire agreement. These Terms, together with our Privacy Policy and any refund policy published at the point of sale, constitute the entire agreement between you and us regarding the Services and supersede all prior understandings. Where you have signed a separate written agreement with us for tutoring or another service, that agreement governs to the extent of any conflict.
Changes to these Terms. We may update these Terms. We will post the revised version with a new "Last updated" date and, for material changes, notify enrolled students by email. Changes apply prospectively. The Terms in effect on the date of your purchase govern that purchase. Continued use after changes take effect constitutes acceptance.
No waiver. No delay, indulgence, waiver, or release by either party of any right under these Terms on any occasion prevents subsequent enforcement of that right or waives any subsequent breach.
Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions remain in full force.
Assignment. You may not assign or transfer these Terms or your account. We may assign these Terms to a successor entity, including in connection with a corporate reorganization or the transfer of our business to an affiliated entity, on notice to you.
Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disaster, war, epidemic, labor disruption, internet or platform outage, or government action.
Accessibility. We are committed to accessible instruction. If you need an accommodation to participate, contact us and we will work with you in good faith.
